Har upphovsrättsindustrin segrat?

Upphovsrättsindustrin har i ett globalt perspektiv kunnat räkna hem ett antal rättsliga framgångar under de senaste åren i sin kamp mot fildelning och det fria tillgängliggörandet av upphovsrättsskyddat material på internet.

Greg sandoval diskuterar i en artikel på cnet-news vad dessa framgångar har haft för påverkan på människors beteende och citerar Mike McCurry, före detta pressekreterare i Bill Clintons administration.

There might be just a point here where the culture is changing on what’s legitimate behavior online,” said Mike McCurry, the former White House press secretary under President Bill Clinton and co-chairman of Arts+Labs, a collaborative group of technology and media companies. “I think perhaps something of a tipping point has been reached where people are finally saying that activity we thought was just okay or skirting around the edge has tipped over into something both dangerous, criminal and unfair.

McCurry tror således att vi nått en punkt där synen på fildelning av upphovsrättsskyddat material håller på att förändras. Han menar att människor i allmänhet inte längre anser att den här typen av aktiviteter är ok.

Jonathan Zittrain, professor i IT-rätt på Harvard Law School och författare till boken “The Future of the Internet and How to Stop It,” invänder i samma artikel att det är inte säkert att upphovsrättsindudustrin går segrande ur striden även om de sociala normerna förändras. Han menar att mängden underhållning och möjliga aktiviteter på nätet som inte är upphovsrättsskyddat har vuxit så kraftigt att det är möjligt att människor i stället kommer att vända sig till den fria konsumentproducerade underhållningen.
